Rights of actual owner of goods

42F. Rights of actual owner of goods

Where the tenant is not the owner of any such goods and the goods are sold by
the landlord in the exercise or purported exercise of his powers under this
Part without notice by the landlord to the owner the owner shall not be
entitled to the return of the goods but shall have the same rights in respect
of the remaining proceeds of the sale of the goods after the deductions have
been made pursuant to section 42D as he would have had in respect of the goods
if the property therein had not passed to the buyer by virtue of the
provisions of this Part. _______________
