Buyer of goods sold pursuant to this Part to acquire a good title

42E. Buyer of goods sold pursuant to this Part to acquire a good title



(1) The buyer of any goods sold by the landlord in the exercise or purported
exercise of his powers under this Part shall acquire a good title to the goods
provided he buys them in good faith and without notice-

   (a)  of any defect or want of title in the tenant; and

   (b)  of any failure by the landlord to comply with any of the provisions of
        this Part.

(2) Upon any proceedings by or against the landlord in respect of any goods
sold pursuant to the provisions of this Part the burden of proving that the
provisions of this Part relating to the sale of those goods have been complied
with shall be on the landlord.
