42. Death of party not to terminate proceedings etc.

Where any party to any proceedings under this Part dies whether before or
after the termination of the proceedings his executor or administrator after
filing in the Magistrates' Court an affidavit showing that he is such executor
or administrator may continue such proceedings or enforce any order thereunder
to the same extent and by the like means and in the same circumstances as such
party might have done if living, and in all cases in which it is necessary so
to do there may be substituted for the name of such party the name of such
executor or administrator as the executor or administrator of the deceased
