Costs where damages do not exceed Fifty cents

41. Costs where damages do not exceed Fifty cents

In case the special damage so laid as aforesaid is not proved, the defendant
shall be entitled to a verdict; and if damage is proved but is assessed by the
jury at a sum not exceeding Fifty cents ($0.50), then the plaintiff shall
recover no more costs than damages unless the judge before whom such trial had
been held certifies upon the record that in his opinion full costs ought to be
allowed.
