Effect of repeal on current leases

24. Effect of repeal on current leases



(1) Any lease granted by the Corporation of the Shire of Ripon or its
successor in law under section 3 of the Burrumbeet (Russell Reserve) Land Act
1982 as in force immediately before the commencement of section 22 of this Act
has effect on and from that commencement as if the lease had been entered into
under section 17D of the Crown Land (Reserves) Act 1978 by the Ballarat City
Council as lessor.

(2) This section has effect in relation to a lease despite anything to the
contrary in that lease.

(3) Nothing effected by this section is to be regarded as placing any person
in breach of, or as constituting a default under, any provision of a lease,
including any provision prohibiting, restricting or regulating the assignment
of the lease.
