Compensation for entry or temporary occupation

47. Compensation for entry or temporary occupation



(1) Any person with an interest in land that has been entered or temporarily
occupied pursuant to Part 9 who has-

   (a)  sustained any pecuniary loss; or

   (b)  incurred any expense-

as a direct, natural and reasonable consequence of that entry or occupation
may claim the amount of that loss or expense from the Authority.

(2) Subject to section 106(1), a claim under subsection (1) must be made
within two years after the day on which the Authority was last in occupation
of or upon the land.

(3) In addition to the amount of loss or expense which may become payable
under subsection (1), the Authority must during the period of its occupation
of the land pay half-yearly or quarterly to the person or persons entitled to
receive the rent from the land the amount of rent agreed upon between the
parties or, failing agreement, fixed by the Court or the Tribunal, as the case
may be.
