Offer to pay total amount of compensation
32. Offer to pay total amount of compensation
(1) If the Minister administering the special Act certifies that it is not
appropriate in the circumstances to set out in an offer under section 31 the
information referred to in subsection (3) of that section, the Authority in
such an offer instead of that information-
(a) must set out the total amount of compensation that the Authority
proposes to pay in respect of the value of all interests in the
acquired land; and
(b) may set out the amounts of compensation which the Authority proposes
to pay for any other matters in respect of which compensation is
payable under this Act.
(2) Subject to section 106(1), the Authority, within seven days after it makes
an offer in accordance with subsection (1), must pay the total amount of
compensation offered into Court.
(3) The Court may provide for the investment of any money paid into Court
under subsection (2) in the same manner as it may invest money paid into Court
under the Supreme Court Act 1958.
(4) As soon as practicable after the payment of money into Court in accordance
with subsection (2), the Authority must apply to the Tribunal or the Court (as
the case may be) for a determination of the amount of compensation which is
payable by the Authority and the person or persons to whom the compensation is
payable, and that application must be dealt with by the Tribunal or Court as a
disputed claim for compensation under this Act.
(5) Subject to section 58, any money paid into Court under subsection (2) and
any interest earned thereon must be paid out in accordance with an order of
the Court or the Tribunal to the persons entitled thereto under this Act.
