Cancellation of notice

15. Cancellation of notice



(1) Subject to section 106(1), the Authority may at any time after the service
of a notice of intention to acquire an interest in land and before-

   (a)  the publication of a notice of acquisition of that interest; or

   (b)  the lapsing of the notice under section 16-

determine not to proceed with the acquisition of the whole or part of that
interest.

(2) If the Authority makes a determination under subsection (1), the Authority
must serve a statement cancelling the notice of intention to acquire upon all
persons interested in the land to which that notice relates and upon whom that
notice was served under section 6.

(3) If the Authority makes a determination under subsection (1) in relation to
part only of land to which a notice of intention to acquire relates, that
determination does not affect the operation of that notice in so far as it
applies to an interest in the remaining part of that land.

(4) A statement under subsection (2) must-

   (a)  be in the prescribed form; and

   (b)  be accompanied by a statement in the prescribed form setting out the
        rights and obligations under this Act of persons upon whom a statement
        under subsection (2) is served.
