40F. Certain information not to be revealed

Any-

   (a)  communication between the trustees, or the members of the committee or
        an employee or agent of the trustees, and an applicant for litigation
        assistance from the trust fund or an assisted person; or

   (b)  document in the possession of the trustees or the committee or an
        employee or agent of the trustees concerning the affairs of an
        applicant for litigation assistance from the trust fund or an assisted
        person-

is privileged from production or disclosure in the same way and to the same
extent as if it were a privileged communication between legal practitioner and
client.
