3. Explanatory Details

1 S. 22C: Section 13 of the Land (Miscellaneous Matters) Act 1993, No. 27/1993 provides as follows:
	13.	Provisions concerning carriageway easement and mortgage
	(1)	The Attorney-General may, under section 22C of the Land Act 1958 authorise the surrender to the Crown of the land referred to in item 23A of Schedule Two B of the Land Act 1958 and that land may be surrendered to the Crown in accordance with that Act despite the existence of the carriageway easement described in Instrument No. 547113 and the mortgage described in Instrument No. 196464.
	(2)	Without limiting section 22C of the Land Act 1958-
	(a)	the easement referred to in Instrument No. 547113 is extinguished; and
	(b)	the mortgage described in Instrument No. 196464 is discharged-
on the registration under the Transfer of Land Act 1958 of a transfer and surrender to the Crown of the land referred to in item 23A of Schedule Two B of the Land Act 1958.

2 S. 22C: Section 16 of the Land (Miscellaneous Matters) Act 1993, 
No. 27/1993 provides as follows:
	16.	Surrender of Peechelba Land
The land described in item 26 of Schedule Two B of the Land Act 1958 may be surrendered in accordance with sections 22C to 22E of that Act despite anything to the contrary in any Act or law or the Folio of the Register of that land.

13 Pt 1 Div. 8 Subdiv. 2: Section 39 of the Crown Lands Acts (Amendment) Act 1994, No. 96/1994 reads as follows:
	39.	Transitional provisions-grazing licences
	(1)	Subject to subsection (2), subdivision 2 of Division 8 of Part I of the Land Act 1958 continues to apply to a licence granted or deemed to have been granted under that subdivision as if Divisions 1 to 3 of Part 2 of this Act had not been enacted.
	(2)	Sections 131 and 132 of the Land Act 1958 as in force immediately before the commencement of this section do not apply to a licence referred to in subsection (1).
	(3)	Despite its repeal, section 130A of the Land Act 1958 continues to apply to the continued occupation by a person granted or deemed to have been granted a licence, and referred to in subsection (1), of the land covered by that licence.

	77.	Transitional provisions
	(2)	A Crown grant issued on or after 30 October 1989 and before the date on which this Act receives the Royal Assent that contains a condition referred to in section 209(4) of the Land Act 1958 (as in force immediately before the commencement of this section) has effect and must be taken always to have had effect as if-
	(a)	it contained the words "submit for certification under the Subdivision Act 1988" instead of the words "make an application under section 569AB of the Local Government Act 1958"; and
	(b)	it contained the words "where the plan of consolidation is certified by the Council, lodge the plan with the Registrar of Titles for registration under the Subdivision Act 1988" instead of the words "where the plan of consolidation is sealed by the Council, lodge the plan with the Registrar of Titles for approval under section 97A of the Transfer of Land Act 1958".
	(3)	Despite anything in the Land Act 1958 or in a Crown grant, if a Crown grant issued before 30 October 1989 contains a condition referred to in section 209(4) of that Act-
	(a)	any reference in the condition to an application under section 569AB of the Local Government Act 1958 must be taken to include a reference to the submission for certification of a plan under the Subdivision Act 1988; and
	(b)	any reference in the condition to the sealing and lodging for approval of a plan must be taken to include a reference to the lodging for registration of a certified plan under the Subdivision Act 1988.
