Infertility Treatment Act 1995 - SECT 67
Information to be given to the Authority about births by other persons
67. Information to be given to the Authority about births by other persons
(1) If a person has been born as the result of a donor treatment procedure the
woman who gave birth or her husband must give written notice in accordance
with this section of the birth to the Authority in the prescribed manner.
Penalty: 20 penalty units.
(2) If a doctor or a registered nurse-
(a) attends the birth of a person; and
(b) knows that the pregnancy resulted from a donor treatment procedure-
the doctor or registered nurse must give written notice of the birth to the
Authority in the prescribed manner. Penalty: 20 penalty units.
(3) A doctor who-
(a) attends a woman during pregnancy and is aware that a person has been
born as a result of that pregnancy; and
(b) knows that the pregnancy resulted from a donor treatment procedure-
must give written notice of the birth to the Authority in the prescribed
manner. Penalty: 20 penalty units.
(4) A notice under subsection (1), (2) or (3) must include the following-
(a) the names of the woman who gave birth and her husband;
(b) the name and sex of the person who has been born, and particulars of
any physical abnormality of the person identified at or about the time
of birth;
(c) if-
(i) the procedure was performed at a licensed centre, the name of that
centre, if known; or
(ii) if the procedure was not performed at a licensed centre, the name of
the doctor who performed it, if known;
(d) any other prescribed information.
(5) A person does not commit an offence under this section-
(a) if that person reasonably believes that another person has already
given a notice under this section which contains all of the
information described in subsection (4); or
(b) in prescribed circumstances.
