Lapsing of consent

38. Lapsing of consent



(1) In the case of donor gametes, the consent of the donor and the spouse (if
any) of the donor given under Part 2 or Part 3 lapses-

   (a)  10 years after it has been given; or

   (b)  if any lesser period has been specified in the consent by the person
        who gave the consent, at the end of that period.

(2) In the case of a donor embryo, the consent of each donor and the spouse
(if any) of each donor under Part 2 or Part 3 lapses-

   (a)  5 years after it has been given; or

   (b)  if any lesser period has been specified in the consent by the person
        who gave the consent, at the end of that period.
