Inspectors must not disclose information
57. Inspectors must not disclose information
(1) A person must not disclose any information that is obtained by her or him
while exercising a power conferred by this Act.
Penalty: 200 penalty units.
(2) A person must not use any such information to obtain directly or
indirectly any pecuniary advantage for herself or himself or for any other
person.
Penalty: 200 penalty units.
(3) However, a person may disclose or use such information if-
(a) the disclosure or use is made in the performance of a duty under, or
in connection with, this Act; or
(b) the person has the consent of the person to whom the information
relates; or
(c) the disclosure or use is made in legal proceedings at the direction of
a court or a tribunal; or
(d) the information is in the public domain at the time it is disclosed or
used; or
(e) the information relates to an offence that the person reasonably
believes may have been committed, and the disclosure is made to a
member of the police force; or
(f) the disclosure is made to a person appointed as the liquidator of a
company that the information relates to.
(4) Subsection (3) is not intended to interfere with any rights another person
may have with regard to the disclosure or use of the information.
