Compensation for damage caused during inspections
52. Compensation for damage caused during inspections
(1) The Secretary must pay compensation for any damage caused by an inspector,
or a person assisting an inspector, in exercising (or purporting to exercise)
any power conferred by this Act.
(2) However, the Secretary is not liable to pay compensation for any damage
caused during any inspection that reveals that there has been a contravention
of this Act.
(3) In determining the amount of compensation payable in relation to any
damage caused to electronic equipment, regard is to be had to whether the
occupier of the premises and the employees and agents of the occupier, if they
were available at the time, had provided any warning or guidance as to the
operation of the equipment that was appropriate in the circumstances.
