Provision of current contact details

51. Provision of current contact details



(1) If an infringement penalty and prescribed costs in respect of an
infringement offence are referred to the Secretary for management by a payment
plan, the enforcement agency must provide the Secretary with the most
up-to-date contact details of the person to whom the payment plan applies.

(2) It is sufficient compliance with subsection (1) if, on deciding to refer
management of the infringement penalty and prescribed costs by payment plan to
the Secretary, an enforcement agency-

   (a)  requests the person to whom the payment plan applies to confirm the
        details of any address that the enforcement agency has in the agency's
        records for that person; and



   (b)  supplies the address confirmed in accordance with paragraph (a) to the
        Secretary when the agency makes a referral under subsection (1).

(3) This section applies despite anything to the contrary in any Act or other
instrument under which the enforcement agency is established or operates.

(4) The Secretary must notify an enforcement agency which referred an
infringement penalty and prescribed costs to the Secretary for management by a
payment plan in respect of a person of the last known address of the person to
whom the payment plan applies if that person-

   (a)  defaults in payment of the plan; or

   (b)  requests the removal of an infringement penalty and prescribed costs
        from a payment plan under section 49(2)(a); or

   (c)  requests the cancellation of a payment plan under section 49(2)(b).
