Who can be a witness?

125. Who can be a witness?



(1) A person cannot be a witness to an enduring power of attorney if the
person is-

   (a)  the donor of the power; or

   (b)  the person appointed as attorney.

(2) Only one of the witnesses can be a relative of the donor of the power or
of the person appointed as attorney.

(3) One of the witnesses must be a person authorised by law to witness the
signing of a statutory declaration.
