Application of Part

105. Application of Part



(1) Except where otherwise expressly provided the provisions of this Part
shall apply only to powers of attorney created on or after the commencement of
the Instruments (Powers of Attorney) Act 1980.

(2) Notwithstanding the repeal of Part XI of the Instruments Act 1958 and
section 94(2) of the Transfer of Land Act 1958 as in force immediately before
the commencement of the Instruments (Powers of Attorney) Act 1980 the
provisions of that Part and that section as so in force shall continue to
apply to and in relation to powers of attorney created before the commencement
of that Act.

(3) Except as expressly provided in Part XIA, this Part does not apply to
enduring powers of attorney.
