Effect of authority under this Part

30. Effect of authority under this Part



(1) An authority under this Part is sufficient authority for a registered
medical practitioner (other than, in a case to which section 29 applies, the
designated officer for the hospital)-

   (a)  to conduct an examination of the body of the deceased person; and

   (b)  to remove tissue from the body of the deceased person.

(1A) A mortuary technician, forensic technician or scientist, under the
general supervision of the registered medical practitioner who is responsible
for the conduct of the post-mortem examination, may remove or assist in the
removal of tissue under subsection (1)(b).

(2) An authority under this Part is authority for the use, for therapeutic,
medical or scientific purposes, of tissue removed from the body of the
deceased person for the purpose of the post-mortem examination.

(3) An order by a coroner under the Coroners Act 1985 directing a post-mortem
examination is, subject to any order to the contrary by a coroner, authority
for the use, for therapeutic, medical or scientific purposes, of tissue
removed from the body of the deceased person for the purpose of the
post-mortem examination.
