Designated public hospital

7. Designated public hospital



(1) The Secretary may, by notice published in the Government Gazette, declare
a public hospital or privately-operated hospital, or any part of a public
hospital or privately-operated hospital, to be a designated public hospital
for the purposes of section 106 and Part 5 if the Secretary is satisfied that
it is desirable so to do on account of the number of older or disabled persons
or persons receiving chronic care in the public hospital or privately-operated
hospital or part, being persons in respect of whom residential care subsidies
under an Act of the Commonwealth are provided.

(2) Where a public hospital or privately-operated hospital or any part of a
public hospital or privately operated hospital is declared to be a designated
public hospital, section 106 applies to that hospital or part as if it were a
supported residential service.

(3) If a privately-operated hospital or any part of a privately-operated
hospital is declared to be a designated public hospital, section 106 applies
to that hospital or part only to the extent to which it provides health
services to public hospital patients.
