State funded residential care service

6. State funded residential care service





(1) The Secretary may, by notice published in the Government Gazette, declare
premises to be a State funded residential care service if-

   (a)  in the opinion of the Secretary a business is carried on at those
        premises on a not-for-profit basis of providing accommodation to
        persons who-

   (i)  require the exercise of nursing supervision and care with occasional
        attendance by a registered medical practitioner; and

   (ii) are persons in respect of whom residential care subsidy under an Act
        of the Commonwealth are provided; and



   (b)  the Government of Victoria provides funds directly or indirectly on a
        recurrent basis for the carrying on of that business.

(2) Any premises in respect of which a declaration under this section was in
force immediately before the commencement of section 5 of the Health Services
(Amendment) Act 1997 are deemed, on that commencement, to be declared under
this section to be a State funded residential care service.
