Censure

59. Censure



(1) If the Minister proposes to censure a registered funded agency, the
Minister-

   (a)  must give notice in writing to the agency of his or her proposal; and

   (b)  must consider any submissions, whether oral or in writing, made to the
        Minister by the agency within 7 days after the giving of the notice;
        and

   (c)  may consider any other submissions and any matters the Minister
        considers appropriate-

before deciding whether or not to censure the agency.

(2) If the Minister decides to censure the agency, the Minister must-

   (a)  give notice in writing of the censure to the agency; and

   (b)  cause to be tabled in each House of the Parliament within 7 sitting
        days of the House after the notice is given to the agency-

   (i)  a copy of the notice; and

   (ii) a report of the circumstances leading to the censure; and

   (iii) a copy of any written submissions made by the agency.
