Notice of proposed direction

40A. Notice of proposed direction



(1) If the Minister proposes to issue the board of a public hospital with a
direction under section 40B, the Minister must give a copy of the proposed
direction to the board at least 7 days before issuing the direction.

(2) The board of a public hospital may give the Minister comments in relation
to the proposed direction before the day on which the direction is to be
issued.

(3) The Minister must take into account the comments of the board of a public
hospital in determining-

   (a)  whether to issue the direction; and

   (b)  if the direction is to be issued, the content of the direction.
