Preliminary assessment of complaint

49. Preliminary assessment of complaint



(1) Within a reasonable period after receiving a complaint but not later than
90 days after the day on which a complaint is lodged, the Health Services
Commissioner must decide whether, and to what extent, to entertain the
complaint.

(2) To enable the Health Services Commissioner to make a decision under
subsection (1), he or she may, by written notice, invite any person-

   (a)  to attend before the Health Services Commissioner for the purpose of
        discussing the subject-matter of the complaint; or

   (b)  to produce any documents specified in the notice.

(3) If the Health Services Commissioner considers it appropriate, he or she
may attempt to resolve the complaint informally.
