What is an interference with privacy?

18. What is an interference with privacy?

For the purposes of this Act, an act or practice of an organisation is an
interference with the privacy of an individual if, and only if-

   (a)  the act or practice breaches Part 5 or a Health Privacy Principle in
        relation to health information that relates to the individual; or

   (b)  the act or practice breaches HPP 7 in relation to an identifier; or

   (c)  the act or practice is or results in a failure to provide access to
        health information that relates to the individual in accordance with
        Part 5 or HPP 6.
