Power to require information from convicted persons

90. Power to require information from convicted persons



(1) If a body corporate is convicted of or found guilty of an offence against
section 85 or 88 the responsible board or the Secretary may require certain
persons to provide specified information to the responsible board or the
Secretary, as provided by this section.

(2) The body corporate may be required to provide information that the
responsible board or the Secretary may reasonably require to ascertain the
identity of each person who is an officer, within the meaning of section 9 of
the Corporations Act, of the body corporate.

(3) A person who the responsible board or the Secretary reasonably believes is
an officer, within the meaning of section 9 of the Corporations Act, of the
body corporate may be required to provide information that the responsible
board or the Secretary may reasonably require to ascertain the identity of
each body corporate in which that person has a management role.

(4) A requirement to provide information is to be imposed by direction in
writing served on the person or body corporate concerned.

(5) The direction must specify a period of not less than 7 days as the period
within which the required information must be provided.

(6) A person must not fail without reasonable excuse to comply with a
requirement under this section.

Penalty: 120 penalty units in the case of a natural person and 600 penalty
units in the case of a body corporate.

(7) A person must not provide information that the person believes is false or
misleading in a material particular.

Penalty: 240 penalty units in the case of a natural person and 1200 penalty
units in the case of a body corporate.
