Offence to provide unregistered health practitioners

84. Offence to provide unregistered health practitioners



(1) A person must not arrange for another person to work as a registered
health practitioner if the person knows or reasonably ought to have known that
the other person is not a registered health practitioner.

Penalty: For a natural person, 60 penalty units; For a body corporate, 300
penalty units.

(2) A person must not arrange for a registered health practitioner to work in
contravention of the terms, or outside the scope, of that health
practitioner's registration if the person knows or reasonably ought to have
known that the health practitioner would be working in contravention of the
terms, or outside the scope, of that health practitioner's registration.

Penalty: For a natural person, 60 penalty units; For a body corporate, 300
penalty units.

(3) A person must not arrange for a health practitioner whose registration is
not endorsed under a provision of Division 2 of Part 2 to work as a health
practitioner whose registration is endorsed under that provision if the person
knows or reasonably ought to have known that the health practitioner's
registration was not so endorsed.

Penalty: For a natural person, 60 penalty units; For a body corporate, 300
penalty units.



(4) A person must not arrange for a health practitioner to work in
contravention of the terms, or outside the scope, of that health
practitioner's endorsement of registration if the person knows or reasonably
ought to have known that the health practitioner would be working in
contravention of the terms, or outside the scope, of that health
practitioner's endorsement of registration.

Penalty: For a natural person, 60 penalty units; For a body corporate, 300
penalty units.
