Refusal to attend or co-operate

53. Refusal to attend or co-operate



(1) If a registered health practitioner or a registered student who is the
subject of an investigation under this Part-

   (a)  does not agree to undergo a health assessment; or

   (b)  does not abide by an agreement to undergo a health assessment-

the investigator must report on the matter to the responsible board together
with any recommendations of the investigator to the board.

(2) After receiving a report from the investigator under subsection (1), the
responsible board may refer the matter to a hearing by a health panel or to
VCAT for a Tribunal hearing.
