Request for conditions or suspension

38. Request for conditions or suspension



(1) A registered health practitioner who believes that-

   (a)  his or her ability to practise as a health practitioner is affected
        because-

   (i)  of his or her physical or mental health; or

   (ii) he or she has an incapacity; or

   (iii) he or she is an alcoholic or drug-dependent person; or

   (b)  he or she has engaged in unprofessional conduct or professional
        misconduct; or

   (c)  his or her professional performance is unsatisfactory-

may ask the responsible board to suspend his or her registration or
endorsement of registration or to impose a condition on the registration or
endorsement of registration.

(2) A student who believes that his or her ability to undertake clinical
training is affected because-

   (a)  of his or her physical or mental health; or

   (b)  he or she has an incapacity; or

   (c)  he or she is an alcoholic or drug-dependent person-

may ask the responsible board to suspend his or her registration or to impose
a condition on the registration.

(3) If the responsible board and the health practitioner or student agree upon
the condition to be imposed, the responsible board may impose it.



(4) If the responsible board and the health practitioner or student do not
agree upon the condition to be imposed, the responsible board must refer the
matter to an investigation under Division 2 of this Part.
