Powers of entry-generally
150. Powers of entry-generally
(1) Subject to this section, an inspector or a person authorised by the
Heritage Council in a particular case, may enter on any building or land at
any reasonable time for the purpose of-
(a) investigating the cultural heritage significance of that building or
land or of an object located in or on that building or land; or
(b) in the case of a registered place, determining whether or not this Act
has been complied with in relation to that place or an object at that
place; or
(c) in the case of a registered object, determining whether or not this
Act has been complied with in relation to that object.
(2) An inspector or authorised person may not, under this section, enter a
residence unless the occupier of the residence has consented in writing to the
entry.
(3) An inspector or authorised person may not, under this section, enter any
other building or land-
(a) unless the occupier of the building or land has consented in writing
to the entry; or
(b) in the absence of that consent, unless 2 days' clear notice is given
to the occupier (if any).
(4) An inspector or authorised person acting in accordance with this section
may-
(a) take photographs (including video recordings); and
(b) make measurements and sketches; and
(c) use any other means of recording information necessary for the
purposes of this Act.
