2.5.29. Application for rescission by police



(1) An officer of police may apply to the Magistrates' Court for rescission of
a declaration that a house or place is a common gaming house or place.

(2) On an application under subsection (1), the applicant must prove on the
balance of probabilities that the house or place is not used as a common
gaming house or place or in contravention of this Part.

(3) The Magistrates' Court may rescind a declaration in the manner referred to
in section 2.5.28(4).
