24. Effect of facility ceasing to be a significant infrastructure facility

If the Minister administering the Essential Services Commission Act 2001,
after considering a recommendation of the Commission, determines that a
facility has ceased to be a significant infrastructure facility-

   (a)  subject to paragraph (b), an existing determination made by the
        Commission (including a price determination under section 33 of the
        Essential Services Commission Act 2001) in respect of prescribed
        services to which the facility relates, is revoked from the date
        specified by that Minister; and

   (b)  an existing price determination made by the Commission, in respect of
        prescribed services to which the facility does not relate, continues
        to operate.
