GUARDIANSHIP AND ADMINISTRATION ACT 2019 - SECT 140
DefinitionsIn this Part—
"medical treatment decision maker "has the same meaning as in the Medical Treatment Planning and Decisions Act 2016 ;
"patient" means a person with a disability (irrespective of whether the person is or is not a represented person) who—
(a) is of or over the age of 18 years; and
(b) does not have decision-making capacity in relation to giving consent to the carrying out of a special medical procedure;
"special medical procedure" means—
(a) any procedure that is intended, or is reasonably likely, to have the effect of rendering permanently infertile the person on whom it is carried out; or
(b) a termination of pregnancy; or
(c) any removal of tissue for the purposes of transplantation to another person; or
(d) any other medical treatment within the meaning of the Medical Treatment Planning and Decisions Act 2016 that is prescribed under this Act to be a special medical procedure for the purposes of this Part.
