Power to make regulations setting fees

58A. Power to make regulations setting fees



(1) The Governor in Council may make regulations for or with respect to
prescribing annual fees to be paid in respect of estates which are the subject
of an administration order.



(2) Regulations made under subsection (1)-

   (a)  may prescribe fees in respect of a particular class or classes of
        estates only; and

   (b)  may prescribe different fees in respect of different classes of
        estates; and

   (c)  may authorise the Tribunal to waive fees in particular cases or
        classes of cases.



(3) Before the Governor in Council may make regulations under this section,
the Minister must advise the Governor in Council that the Minister-

   (a)  has consulted the President and the Public Advocate; and

   (b)  is of the opinion that the fees to be charged in the proposed
        regulations will not result in an amount of fees being collected in
        any year that will exceed the amount required by the Tribunal and the
        Public Advocate to fulfil their estate administration functions under
        this Act in that year.
