Administrator may seek advice

55. Administrator may seek advice



(1) An administrator may apply for the advice of the Tribunal upon any matter
relating to the scope of the administration order or the exercise of any power
by the administrator under the administration order.

(2) Without limiting subsection (1), the jurisdiction of the Tribunal includes
jurisdiction in the case of an administration by State Trustees to approve,
order or advise the commencement of proceedings by State Trustees acting in
one capacity or on behalf of one represented person against State Trustees
acting in another capacity or on behalf of another represented person.

(4) The Tribunal may-

   (a)  approve or disapprove of any act proposed to be done by the
        administrator; and

   (b)  give such advice as it considers appropriate; and

   (c)  make any order it considers necessary.

(4A) The Tribunal may on its own initiative direct, or give an advisory
opinion to, an administrator concerning any matter.

(5) An action does not lie against an administrator on account of an act or
thing done or omitted by the administrator under any order or on the advice of
the Tribunal made or given under this section unless in representing the facts
to the Tribunal the administrator has been guilty of fraud, wilful concealment
or misrepresentation.
