Consent of Tribunal to special procedure
42E. Consent of Tribunal to special procedure
On hearing an application under this Division, the Tribunal may consent to the
carrying out of a special procedure only if it is satisfied that-
(a) the patient is incapable of giving consent; and
(b) the patient is not likely to be capable, within a reasonable time, of
giving consent; and
(c) the special procedure would be in the patient's best interests.
