42. Unlawful consent to medical or other treatment an offence

A person must not-

   (a)  purport to give consent to the continuation of a special procedure or
        a further special procedure under section 42F, or to a medical
        research procedure or to any medical or dental treatment on behalf of
        a patient; or

   (b)  represent to a registered practitioner that he or she is authorised to
        give such consent-

knowing that he or she is not authorised to give such consent or without
reasonable grounds for believing that he or she is authorised to give such
consent. Penalty: 20 penalty units.
