Authority of alternative guardian

35. Authority of alternative guardian



(1) If an alternative guardian is appointed, the alternative guardian takes
over the office of plenary guardian or limited guardian (as the case may be)
without further proceedings immediately upon the death or during the period of
absence or incapacity of the original guardian.

(2) The alternative guardian must notify the Tribunal in writing of the death,
absence or incapacity of the original guardian and send to the Tribunal
evidence of the death, absence or incapacity of the original guardian.

(3) Where an alternative guardian takes over the office of a guardian, the
alternative guardian has the same powers and duties with respect to the
represented person as the guardian had immediately before the guardian's
death, absence or incapacity.
