Guardianship and Administration Act 1986 - SECT 33

Temporary order

33. Temporary order



(1) If the Tribunal is satisfied that the person in respect of whom an
application has been made under section 32-

   (a)  is a person with a disability; and

   (b)  is unable to make reasonable judgments in respect of all or any of the
        matters relating to her or his person or circumstances; and

   (c)  is in need of a guardian-

the Tribunal may make a temporary order appointing any person eligible to be
appointed under section 23 as the plenary guardian or limited guardian of that
person.

(2) A temporary order-

   (a)  remains in effect for such period not exceeding 21 days as is
        specified in the order; and

   (b)  may be renewed once for a further period not exceeding 21 days.

(3) The Tribunal must hold a hearing to determine whether a guardianship order
should be made under section 22 as soon as practicable after the making of a
temporary order but within 42 days of making that order.
