Decision about contact with child
91. Decision about contact with child
(1) If the court decides to make a family violence intervention order and the
protected person or the respondent is the parent of a child, the court must
decide whether or not it will jeopardise the safety of the protected person or
child for the child to live with, spend time with or communicate with the
respondent.
(2) For the purposes of making a decision under subsection (1), a previous
lack of violence by the respondent towards the child is not on its own
sufficient reason to decide that the child's safety will not be jeopardised by
living with, spending time with or communicating with the respondent.
