Bail on appearance on arrest

52. Bail on appearance on arrest



(1) The Bail Act 1977 applies to and in respect of a respondent to an
application for a family violence intervention order arrested under a warrant
as if the respondent were an accused person charged with an offence to whom
section 4 of the Bail Act 1977 applies.

(2) For the purposes of subsection (1), the appropriate person must-

   (a)  advise the affected family member of the outcome of the application
        for bail; and

   (b)  if bail is granted--

   (i)  advise the affected family member of any special conditions imposed on
        the respondent that are intended to protect the affected family
        member; and

   (ii) give the affected family member a copy of the undertaking of bail.

(3) In subsection (2)-

appropriate person means-

   (a)  if bail is granted by a court, the appropriate registrar of the court;
        and

   (b)  if bail is granted by a police officer, the police officer.
