Form of family violence safety notice

27. Form of family violence safety notice



(1) If a police officer issues a family violence safety notice under section
26 on an application made in person, the police officer must-

   (a)  include in the notice matters referred to in section 32; and

   (b)  make the notice on oath or by affidavit or certify the notice.

(2) If a police officer issues a family violence safety notice on an
application made by telephone, fax or other electronic communication, the
police officer must-

   (a)  complete a form (an authorisation form) that contains the following
        information-

   (i)  the names of the respondent and protected person;

   (ii) the name, rank and station of the police officer who made the
        application;

   (iii) a brief statement of the reasons for issuing the family violence
        safety notice;

   (iv) the conditions of the family violence safety notice; and

   (b)  certify the authorisation form; and

   (c)  inform the officer who made the application of the terms of the
        authorisation form referred to in paragraph (a)(iii) and (iv).

(3) If a family violence safety notice is issued on an application made by
telephone, fax or other electronic communication, the police officer who made
the application must-

   (a)  complete a form (a safety notice form) that includes the information
        referred to in section 32; and

   (b)  certify the safety notice form.
