FAMILY VIOLENCE PROTECTION ACT 2008 - SECT 166

Restriction on publication of proceeding in Magistrates' Court

    (1)     This section applies to—

        (a)     a proceeding under this Act, other than in the Children's Court; or

        (b)     an order made under this Act, other than by the Children's Court; or

S. 166(1)(c) inserted by No. 42/2014 s. 123(b).

        (c)     a litigation restraint order proceeding in the Magistrates' Court; or

S. 166(1)(d) inserted by No. 42/2014 s. 123(b), amended by No. 53/2016 s. 66(1)(a).

        (d)     an order made by the Magistrates' Court under the Vexatious Proceedings Act 2014 that relates to an application or a proceeding under this Act;

        (e)     a proceeding for a variation, extension or revocation of a recognised DVO, other than in the Children's Court, and the recognised DVO to which that proceeding relates; or

S. 166(1)(f) inserted by No. 53/2016 s. 66(1)(b).

        (f)     a declaration made by the Magistrates' Court under Part 7 of the National Domestic Violence Order Scheme Act 2016 , and the recognised DVO to which that declaration relates.

For a proceeding in the Children's Court, see section 534 of the Children, Youth and Families Act 2005 which provides restrictions on the publication of proceedings in that Court.

    (2)     A person must not publish, or cause to be published, a report of the proceeding or about the order that contains—

S. 166(2)(a) amended by No. 77/2014 s. 18.

        (a)     if a party to or a witness in the proceeding, or a person the subject of the order, is a child—

              (i)     the locality or any particulars likely to lead to the identification of the particular venue of the court; or

S. 166(2)(a)(ii) amended by No. 77/2014 s. 18.

              (ii)     any particulars likely to lead to the identification of the child or any other person involved in the proceeding, either as a party to the proceeding or as a witness in the proceeding, or the subject of the order—

unless the court orders under section 169 that the locality or particulars may be published; or

        (b)     if paragraph (a) does not apply—     any particulars likely to lead to the identification of any person involved in the proceeding or the subject of the order, unless the court orders under section 169 that the particulars may be published; or

        (c)     a picture of or including a person concerned in a proceeding for a family violence intervention order or a variation, extension or revocation of a recognised DVO, unless the court orders under section 169 that the picture may be published.

Penalty:     In the case of a natural person, 100 penalty units or 2 years imprisonment or both;

In the case of a body corporate—500 penalty units.
