Implied conditions in supply of services

32J. Implied conditions in supply of services

In a contract of supply of services there is-

   (a)  an implied condition that the services will be rendered with due care
        and skill; and

   (b)  in the case of a supply of services by a person who supplies the
        services in the course of a business, an implied condition that the
        services are as fit for the purposes for which services of that kind
        are commonly purchased as it is reasonable to expect having regard to
        the price of the services, the terms of the supply and all other
        relevant circumstances.
