When is a person aware of a fact, matter or circumstance?

32C. When is a person aware of a fact, matter or circumstance?



(1) For the purposes of this Part, a person is not deemed to be aware of a
fact, matter or circumstance by reason only that the person has signed a
document or writing-

   (a)  stating that fact, matter or circumstance; or

   (b)  stating that the person is aware of that fact, matter or circumstance.

(2) For the purposes of this Part, a person is deemed to be aware of a fact,
matter or circumstance if the person has been informed or learnt of it in a
manner and in circumstances that would reasonably be expected to cause a
reasonable person to become aware of the fact, matter or circumstance.
