Publications which are not prohibited

32. Publications which are not prohibited



(1) Sections 9, 10, 11, 12 and 20 do not apply to a publication which is made
by an information provider in the course of carrying on the business of
providing information unless the publication-

   (a)  is an advertisement; or

   (b)  relates to-

   (i)  goods or services supplied or the possible supply of goods or
        services; or

   (ii) a business activity carried on- by the information provider or, if the
        information provider is a body corporate, a related body corporate.

(2) In this section-

information provider means any of the following-

   (a)  a person who holds a commercial television broadcasting licence under
        the Broadcasting Services Act 1992 of the Commonwealth;

   (b)  the Australian Broadcasting Corporation;

   (c)  the Special Broadcasting Service;

   (d)  any other person who carries on the business of providing information.
