Right to payment for unsolicited goods or services

24. Right to payment for unsolicited goods or services



(1) A person must not, in trade or commerce, assert a right to payment from
another person for the supply of unsolicited goods or services unless the
person who asserts the right has reasonable cause to believe that there is a
right to payment.

Penalty: 240 penalty units, in the case of a natural person.
600 penalty units, in the case of a body corporate.

(2) In proceedings for an offence under subsection (1), the burden of proving
that the defendant had reasonable cause to believe there was a right to
payment lies on the defendant.
