Where request refused

46. Where request refused



Where-

   (a)  an agency or Minister refuses to amend a record pursuant to a request
        under section 39;

   (b)  the person who made the request applies to the Tribunal for a review
        of the decision; and



   (c)  the Tribunal affirms the decision-





the person who made the request may, by notice in writing, require the agency
or Minister to add to the record a notation-

   (d)  specifying the respects in which the information is claimed by him to
        be incomplete, incorrect, out of date or misleading; and

   (e)  in a case where the information is claimed by him to be out of
        date-setting out such information as is claimed to be required to
        bring up to date or complete the information.
