Returns by financial institutions

35. Returns by financial institutions



(1) Each financial institution that is registered or required to apply for
registration in accordance with the provisions of section 33, shall, within 21
days after the end of each month, furnish to the Commissioner, a return
relating to that month in which he specifies-

   (a)  the total of the dutiable receipts, other than broker receipts and
        dutiable receipts referred to in paragraph (b); and

   (b)  the number of dutiable receipts, other than broker receipts of, or
        exceeding, $2 000 000-

that were received by him during that month.

(2) Where, in respect of a month, section 18, by reason of section 23(3), has
effect as if a reference to a financial institution were a reference to a
person nominated or appointed in relation to a group for the purposes of
section 23(3)-

   (a)  that person shall, within 21 days after the end of the month, furnish
        to the Commissioner a return relating to that month in which he
        specifies-

   (i)  the total dutiable receipts of each member of the group during that
        month other than dutiable receipts referred to in subparagraph (ii);

   (ii) the number of dutiable receipts of each member of the group during
        that month of, or exceeding, $2 000 000; and

   (iii) the total dutiable receipts of each member of the group during the
        period of twelve months immediately preceding that month; and

   (b)  each member of the group specified in a return so furnished shall be
        deemed to have furnished, when the first-mentioned return is
        furnished, a return under subsection (1) relating to that month.
