41. Reviews



(1) A person may apply to the Tribunal for review of-

   (a)  a requirement or prohibition placed on that person by a confirmed
        interim conservation order;

   (b)  a decision of the Secretary under a confirmed interim conservation
        order that affects that person's interests;

   (c)  a decision of the Minister to suspend that person's licence, permit or
        other authority under section 38.

(2) If the Secretary has not determined an application for a permit within 30
days after it is lodged, the Secretary is deemed to have made a decision
refusing the application at the end of that 30-day period.

(3) An application for review must be made-

   (a)  within 30 days after the day on which the applicant was advised of the
        requirement, prohibition or decision; or

   (b)  in the circumstances referred to in subsection (2), within 30 days
        after the end of the 30 day period referred to in that subsection.
