Notice to comply

36. Notice to comply



(1) At any time during the operation of an interim conservation order the
Secretary may serve notice on any person-

   (a)  who is a landholder of land or a manager of water which forms part of
        the critical habitat which is the subject of the order; or





   (b)  who is carrying on an activity outside the critical habitat which is
        the subject of the order which is likely to detrimentally affect the
        critical habitat-

requiring them to comply with the order.

(2) A person must comply with a notice issued under subsection (1).

Penalty: 100 penalty units.

(3) In addition to any penalty imposed under subsection (2), a person who is
convicted of an offence against the subsection is liable to a continuing
penalty of 10 penalty units for each day on which the failure to comply with
that subsection continues after conviction.
